Super English ESL is an online education business providing digital ESL curriculum, educational resources, online English instruction, teacher memberships, teacher group access, and school and educational-program access.

2. Who These Terms Apply To

These Terms apply to all visitors, subscribers, teachers, tutors, students, parents, teacher groups, tutoring businesses, schools, educational programs, and other users of Super English ESL.

By using the website or purchasing our services, you confirm that the information you provide is accurate and that you will use our services and materials only in accordance with these Terms and applicable law.

3. Products and Services

Super English ESL provides online educational products and services, which may include:

• individual teacher subscriptions to the Super English ESL curriculum;
• ready-to-teach digital ESL lessons and educational materials;
• downloadable homework and supplementary teaching resources;
• adult and children's ESL curriculum materials;
• speaking, reading, grammar, vocabulary, and phonics resources;
• teacher group plans for multiple educators;
• school and educational-program plans;
• online English-language classes for individual students;
• packages of online English-language classes; and
• other related educational services.

Some services are purchased directly through our website, while teacher group plans, school plans, class packages, and certain educational services may be quoted and invoiced separately.

4. Accounts, Subscriptions, and Free Trials

Some areas of the website require an account and an active subscription. When creating an account, you agree to provide accurate and current information and to keep your login details secure.

Super English ESL may offer monthly, 6-month, and annual individual subscription plans, including promotional free trials.

If a free trial is offered, billing begins automatically at the end of the trial period unless you cancel before the trial ends.

By purchasing a recurring subscription, you authorize Super English ESL and its payment service providers to charge your selected payment method according to the billing schedule for the plan you selected.

Prices, plan details, curriculum content, and included features may change from time to time. Updated pricing will apply to future purchases or billing periods as permitted by applicable law.

5. Teacher Group Plans

Super English ESL offers custom teacher group plans for independent groups of ESL teachers, tutoring teams, teaching communities, tutoring businesses, and other educational organizations that require access for multiple teachers.

Teacher group plans may have custom pricing based on factors such as the number of participating teachers, the length of access, account-management requirements, and other agreed services.

Pricing, number of authorized users, subscription term, payment terms, and other group-specific conditions may be stated in a quote, invoice, written agreement, or order confirmation provided by Super English ESL.

Unless expressly authorized under the applicable group plan, access may not be shared with individuals outside the approved group.

6. School and Educational Program Plans

Schools, school districts, tutoring centers, language programs, and other educational organizations may purchase multi-teacher access to Super English ESL.

School plans may include multiple teacher accounts, centralized account administration, invoicing, purchase-order support, and other school-specific arrangements.

The number of authorized users, subscription period, pricing, payment terms, and other conditions for a school or educational-program purchase may be stated in the applicable quote, invoice, purchase order, agreement, or order confirmation.

7. Online English Classes and Class Packages

Super English ESL may provide online English-language instruction to individual students. Students may purchase individual lessons or packages of lessons where offered.

The number of lessons, lesson length, price, scheduling arrangements, payment terms, and any other conditions applicable to a class package may be stated on the applicable invoice, order confirmation, or written agreement with the student or customer.

Online classes are delivered electronically at times agreed upon between the student and teacher. No physical product is shipped in connection with online English classes.

8. Payments and Invoices

Payments may be collected through our website, through a payment link, or through an invoice issued by Super English ESL using one of our authorized payment service providers.

When an invoice is issued, the invoice may identify the customer, educational product or service purchased, amount due, currency, payment deadline, and other applicable payment terms.

By paying an invoice, you authorize payment for the products or services described on that invoice and agree to any applicable terms stated on the invoice or related agreement.

Customers are responsible for providing accurate billing and payment information.

9. Delivery of Digital Services

Curriculum Memberships

Curriculum subscriptions and memberships are digital services. Access is provided electronically through a Super English ESL account. No physical products are shipped for curriculum subscriptions.

Teacher Group and School Access

Teacher group and school-plan access is provided electronically. Approved teachers may receive individual accounts, invitations, or other account access according to the applicable group or school plan.

Online Classes

Online English-language classes are delivered remotely at the agreed dates and times.

10. Cancellations and Refunds

Individual Subscriptions

You may cancel an individual recurring subscription through your account settings, billing portal, or by contacting Super English ESL.

When you cancel, your subscription will generally remain active until the end of the current paid billing period unless otherwise stated.

Except where required by applicable law, payments for subscription periods that have already begun are non-refundable, and we do not generally provide refunds or credits for unused time, partial billing periods, or failure to use the service.

If you sign up through a free trial, you must cancel before the trial ends to avoid being charged for the applicable paid subscription.

Teacher Group and School Plans

Cancellation and refund terms for teacher group plans, school plans, and custom educational arrangements may be stated in the applicable quote, invoice, purchase order, order confirmation, or written agreement. Where no separate terms are provided, payments are non-refundable once access to the purchased service has been activated, except where otherwise required by law.

Online Classes and Class Packages

Any cancellation, rescheduling, credit, expiration, or refund conditions specific to online classes or class packages may be communicated at the time of purchase or included on the applicable invoice or agreement.

11. Permitted Use of Materials

An individual teacher subscription gives the authorized subscriber a limited, non-exclusive, non-transferable license to use Super English ESL materials for that subscriber's own teaching and lesson preparation.

• Use materials in live classes, online classes, and one-to-one instruction.
• Download and print permitted materials for your own teaching use.
• Display lesson content to your own students during instruction.
• Use the curriculum for personal lesson planning and classroom preparation.

Teacher group and school-plan customers may use the materials according to the number of teachers and accounts authorized under their applicable plan.

Access to Super English ESL does not transfer ownership of any content or intellectual property to the user.

12. Prohibited Use

To protect our curriculum, teachers, and subscribers, you agree not to:

• share an individual account login with another teacher or unauthorized person;
• exceed the number of users permitted under a teacher group or school plan;
• upload, post, email, sell, sublicense, or redistribute our lessons or downloads except as expressly permitted;
• share subscriber-only materials publicly or through shared drives, marketplaces, forums, public websites, or file-sharing services;
• give students or unauthorized users direct access to subscriber-only portions of the website;
• copy, scrape, bulk-download, or reproduce our content using bots, scripts, automated tools, or similar technologies;
• modify, remove, or conceal copyright notices or Super English ESL branding;
• resell access to Super English ESL unless expressly authorized in writing;
• use the website for unlawful, abusive, fraudulent, or unauthorized purposes;
• attempt to interfere with website security, access controls, or normal operation.

We may suspend or permanently terminate accounts involved in misuse, unauthorized sharing, fraud, abuse, or copyright violations.

13. Intellectual Property

All website content and curriculum materials, including lessons, worksheets, homework, images, graphics, downloads, branding, website design, text, and other educational content, are owned by Super English ESL or licensed to us and are protected by applicable copyright, trademark, and other intellectual property laws.

Except for the limited teaching rights granted under these Terms, you may not reproduce, republish, distribute, sell, sublicense, create derivative commercial products from, or otherwise commercially exploit our materials without prior written permission from Super English ESL.

14. Free Content and Preview Lessons

Super English ESL may provide free lessons, sample lessons, lesson previews, placement resources, and other publicly accessible materials.

Free access does not transfer ownership or provide unrestricted rights to redistribute the content.

Unless expressly stated otherwise, free materials may not be reposted, resold, uploaded, or redistributed through public websites, social platforms, file-sharing services, marketplaces, or other public channels.

15. Account Security

You are responsible for activity occurring under your account and for keeping your username, password, and other login information confidential.

Teacher group and school administrators are responsible for managing access to their group accounts and for removing users who are no longer authorized to participate in the applicable plan.

Please notify Super English ESL promptly if you believe an account has been accessed without authorization.

To the extent permitted by law, Super English ESL is not responsible for losses resulting from a customer's failure to maintain reasonable account security.

16. Website Availability and Changes

We may update, improve, replace, or discontinue portions of the website, curriculum, lessons, features, pricing, or subscription structure as the service develops.

We may also correct errors and update lesson content or educational resources.

We do not guarantee uninterrupted access. The website may occasionally be unavailable due to maintenance, technical issues, security events, internet outages, or interruptions involving third-party service providers.

17. Suspension and Termination

We may suspend or terminate access if we reasonably believe a user has violated these Terms, misused the website, engaged in fraud or abuse, infringed intellectual property rights, shared unauthorized access, or otherwise engaged in activity that could harm Super English ESL, its customers, or its services.

You may stop using the website at any time and may cancel recurring subscriptions as described in these Terms.

18. Third-Party Services and Payment Providers

We do not guarantee specific educational outcomes, student performance, business results, customer growth, or teaching outcomes.

Teachers, schools, parents, and other educators remain responsible for determining whether particular materials are appropriate for their students and teaching environments.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Super English ESL will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website, curriculum, or related services, including loss of data, revenue, business opportunity, or business interruption.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

21. Governing Law

These Terms of Service and any dispute arising out of or relating to Super English ESL, the website, our subscriptions, invoices, educational services, or these Terms shall be governed by the laws of the State of Minnesota and the applicable laws of the United States, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising from these Terms or the services provided by Super English ESL shall be brought in a court of competent jurisdiction located in Minnesota, United States.

Nothing in this section limits any consumer rights that cannot legally be waived under applicable law.
